The Bamba Group Corporation and/or their Platforms value and understand the importance of protecting the safety and privacy of the personal information pertaining to any individual that enters the Webpage and/or Application. Please note that all capitalized words shall have the meaning determined in the Bamba Group Corporation General Use and Traveler Terms and Conditions (hereinafter referred to as the “Terms and Conditions”).

The policies hereunder detail the use of the information that comes into our possession as a result of the use of the Bamba Group Corporation Platform and/or Application, or of the Content uploaded thereon by Users and/or visitors.

The Bamba Group Corporation Platform and/or Application and all Content uploaded therein is owned and operated by Bamba Group Corporation, which together with our affiliates, shall be hereinafter referred to as “us”, “we” or “our”. Likewise, when referring to “you” and “your”, it implies any Users and/or visitors of the Platforms and/or Application.

Please carefully review the provisions hereunder, before entering the Platform and/or Application, or uploading any of your personal or whichever information, and be advised that by entering and using the Platforms and/or Applications, you agree, acknowledge, and subscribe to the terms hereunder.

I. Collecting your Personal Information

Personal information refers to any data that comes into our possession, by means of which a particular individual may be recognised and identified. The definition and scope of what can and cannot be considered as personal information may vary depending on the applicable law in different countries and states, but for purposes hereunder, it refers to your name, mailing address, e-mail, and phone number. In some cases, it also includes your computer or mobile device IP address, when it can be linked to a particular person, or geographical location that enables locating a specific person.

No individual is required to hand over their personal information, and neither do we require it for general access to the Platform and/or Applications. Should you wish to be able to access certain features and/or hire, book, or pay for any of the Services we offer, we may request for you to create an account, which will enable you to send requests and inquiries pertaining to the upcoming tailor-made trip or experience you may be planning. The complete list and classification of such information is found below, and certain information may be classified under more than one category. In any case, you agree and state that any information you provide is true, precise, up to date, and verifiable, and it is your responsibility entirely, for it to remain as such:

  1. Contact Information

    Refers to that which: (i) enables you to be identified as an individual (for example, your first and last name); (ii) official government-issued information that allows us to confirm your identity (for example, your passport or other government-issued ID numbers); and, (iii) information by means of which we can contact you (mobile number, e-mail, and/or mailing address). The contact information referred to is requested to create an account on the Platform and/or Application; when you ask for information regarding an upcoming trip you wish to plan; request a quote; and/or, if you wish to be notified of special offers on our monthly newsletter, if you chose to “Contact Us” on the Platform, and/or to have access to whichever other advertising materials, and/or when you publish Feedback or Content of any type.

    The information requested is used for purposes of: (i) personalising your preferences and experience upon accessing our Platform and/or Services; (ii) certifying your identity and that you meet the requirements to access our Platform and Services; (iii) carrying out transactions, managing your account, providing information on the destinations of your interest and/or of our local operators, for them to assist you in planning your experience, and contact you for such purposes; (iv) send you our monthly newsletter and/or other advertising material, prior to asking for your permission to do so; (v) provide you with any information you may inquire on; and, (vi) monitor the use of the website, in order to prevent fraud or misuse of it.

    We are entitled to request this information, as a result of our main business purposes, which is to assist you in planning any future trips and/or whichever other Services related thereto, and advertise such Services, for which we will always ask for your previous authorization to send such material. Likewise, we will only keep this information, for as long as it may be necessary, to continue providing our Services and information related thereto, during the time in which you continue to have an active account and wish to receive information on such Services. The aforementioned includes any needs relating to our business, which may range from legal to taxing, accounting and/or risk analysis, or whichever other aspects related to our business in connection with you.

  2. User Information

    User Information refers to that which you upload onto the Platform, as a result of participating in the interactive Bamba Group Corporation platforms. For example, if you publish reviews or feedback, if you want to have access to certain promotions or comment in any way, as a User in our interactive community. Such information may vary in nature, according to how you wish to participate, or of any promotions or online challenges we may summon our Users to participate in, but it usually includes information regarding your name, some images or photographs in which you may appear, your voice, profile information and/or information you would choose to share regarding past trips and experiences.We collect this information to allow other people to learn and benefit from your experience, by means of our interactive platforms, and we are entitled to do so, because such platforms are the main vehicle that allows us to provide our services, and for our users to rate them and for others to learn more about them. In any case, we only share the information that you expressly authorize us to share, when you submit a review. We only store the information for the duration required to serve the purpose of sharing information on past trips and Services hired from Bamba Group Corporation. Likewise, you can always request for your information to be removed, and as long as the Platform and/or Application allows it, we will do so; or, in case we are not able to remove it, we will inform you of it.

    NOTE that the information you publish, becomes public once you upload it onto any of our interactive platforms, and therefore other people can view it, forward and republish it, as long as our platforms remain active, and may remain visible if the pages are archived. We do not make ourselves responsible for the information you chose to publish, therefore we encourage users to review the information they may wish to publish unless you have no inconvenience with it being viewed by other people.

  3. Billing Information

    As referred to in the Terms and Conditions, the Platform and/or Application provides a secure payment platform, in case you wish to purchase the services offered by our Travel Gurus or whichever other local operators and/or if you purchase travel insurance. To that effect, the third-party providers that facilitate the platform may request your billing information, including your credit or debit card number, bank account and/or billing address; which we might then use to process such payments.

    We are entitled to request this information, as a means to facilitate the purchase and arrangement of your future travel plans and/or experiences, and shall only store it for the duration necessary to process your payment and secure your travel plans, unless you expressly authorise us to save such information on your account, to facilitate future purchases.

  4. Travel Information

    In order to provide our Services, which consists of helping you plan your ideal trip, and contact you with the local experts that will provide it, we will ask for information regarding your future travel plans and/or past trips, which includes your personal information, information on the countries you have visited previously, as well as, the format and details thereto, like if you traveled alone or with a group, and your comments and/or feedback regarding such trips. Likewise, in case it is necessary to make particular adjustments to the Services we provide, we may inquire about your health and/or dietary restrictions, or other restrictions of any kind. We might also keep a record of your communication with the local experts, for purposes of monitoring that your travel plans continue as planned and agreed to.

    Our need to collect such information derives from the legitimate objectives we pursue with our business, as well as to accommodate and monitor the quality of our Services, ensuring that the Webpage and Application, operate properly in order for Our Users and/or visitors to obtain all possible information and make sure that it is helpful in planning their experiences. Likewise, if you are satisfied with our Services, we might wish to allow others to learn from your experience, so that they may be encouraged to hire us going forward.

    We guarantee that the information we collect, we will only store for as long as may be necessary to continue providing the Services, or unless the law specifically requires us to keep it for a specific period of time. Should you wish to recover such information, or remove any reviews or other information that you may have published relating to your own experience with Bamba Group Corporation or any of your trips, please consult the section on “User Information”.

  5. Information on other people

    In case you are planning a trip for persons other than yourself, we will request their information as well, such as their name, e-mail address, date of birth, and other information regarding the people that will be traveling with you. Upon sharing such information, you warrant that you obtained the consent of such person to provide us that information, for us to use it in terms of this policy.

    The information we request is for purposes of providing it to the Travel Gurus and/or whichever other local operators assisting in the trip you may be planning, in order for them to make the corresponding reservations. According to our Privacy Policy, we are entitled to request this information in order to provide our Services, and unless we are required by law to keep it for any specific period, we shall store it solely for the duration needed to provide our Services.

  6. Local Agent Information

    In order to work with baboo as a Travel Guru or otherwise local operator, the interested operators must provide the information requested regarding their agency, reputation, personal identification information, whether personal or of other persons working with them, as well as, the agency permit to operate as such, including data management platform and/or the necessary information regarding the payment process and/or required by the payment platforms.

    The information requested is for purposes of evaluating and allowing you to work as a local operator, in such a manner as to meet the criteria set forth in the corresponding operator agreement, and such agreement entitles us to request this information. We shall store it solely for the duration necessary to continue providing the Services that form part of our business purposes, or unless by law we are required to keep it for any specific period.

II. Purposes and Motives for Sharing Information

We may be required to provide personal information to third parties, for purposes of:

  1. enabling the local operators to help you arrange and book your trip;

  2. enabling our payment service providers to process, secure, refund, and/or in any way address queries relating to payments and refunds;

  3. enabling our insurance providers to issue and manage the requested policy;

  4. enabling our community and data management providers to distribute our newsletter, promotional, or whichever other advertising material;

  5. enabling our corporate affiliates to provide you periodic mail regarding services, products, and/or events of their interest;

  6. enabling third parties to provide marketing services in certain countries;

  7. complying with any laws, regulations, legal requirements, judicial or whichever other government request, policies applicable to the platforms or violations thereto;

  8. and/or in the case of any potential and/or regarding upcoming mergers, sale of company assets, financing or acquisition of all or part of the Bamba Group Corporation.

If you do not wish for us to share your information for any of the previously mentioned purposes, please let us know by contacting us at help@baboo.travel. Likewise, we warrant and ensure all Users and/or visitors that under no circumstances, do we sell, rent, lease and/or disclose any information we collect from you to anyone, for any purposes other than those previously mentioned, and/or, do we do so without previously requesting your written consent.

III. Personal Information Rights

  1. General Rights:

    As previously noted, you are entitled at any time to stop receiving promotional material such as our newsletters, by selecting the “unsubscribe” link contained in any and all email communications, or by contacting us at help@baboo.travel. After doing so, we will cease to send any marketing material. However, please be advised that we will still need to contact you, should you have any upcoming travel plans booked with us, in order to arrange details, and/or should it be legally required.

    If you have an account with us, you can access and edit any information therein provided, by signing in to your account and selecting the information you wish to edit. You can also edit and update any previous reviews uploaded to the platform, or contact us at any time at help@baboo.travel, to request whichever changes you wish to make regarding the personal information disclosed in order to set up the account. For any additional questions regarding the privacy policy hereunder or our use of your personal information, please contact us at help@baboo.travel.

    Our common practice relating to the duration for which we maintain and store your information is described above, however, should you wish for earlier removal of your information, please contact us at help@baboo.travel. Please note that whether or not we may be able to remove your information, is determined on a case-by-case basis, and in some cases, it may not be possible. For example, if the data is not in a searchable format; if it is stored in a backup system; cached or archived pages; if it is required to prevent fraud or future abuse; and/or, if we are required by law to keep it.

  2. Delaware Residents:

    Delaware law permits its residents to request details about how we disclose personal information to third parties for such third parties’ own marketing purposes. If you are a Delaware resident and would like to request this, please contact us at help@baboo.travel. Please note that there are legal limits regarding the frequency of such requests, and we are only compelled to respond to one information request per customer per year.

    In addition, although users of our platforms must be at least 18 years old to enter, any Delaware residents under this age that has improperly used the site can request removal by contacting us at help@baboo.travel; detailing the location of such content and confirming it was them that posted it. Following such request, we will terminate the unauthorized account and will make reasonable good faith efforts to remove the content from public view, or make it anonymous, in order to avoid exposing such minor. Nonetheless, removal can under no circumstances, ensure complete or comprehensive removal, or that third parties abstain from manipulating web content in such a manner that may be out of our reach.

  3. EU Citizens/Residents:

    For users in the European Union (EU), the privacy policy hereunder attempts to comply with Regulation (EU) 2016 of the European Parliament and of the Council of 27 April 2016, (the “General Data Protection Act” or “GDPR”). If you are in the EU, you have the following rights, subject to certain limitations and exceptions imposed by the GDPR:

    a. Access: The right to request copies of your personal information.
    b. Correct: The right to ask for personal information to be corrected in case it is inaccurate or incomplete.
    c. Erase: The right to request removal or deletion of your personal information from our databases.
    d. Restrict Use: The right to block or limit the ways in which we can use your personal information.
    e. Data Portability: The right to request that your personal information is transferred to another provider.
    f. Object: The right to oppose yourself to our use of your personal information, even if it is for legitimate interests or marketing purposes.

IV. Social Media Sharing

In case you agree to allow a connection between our Platform and common social media networks, such as Facebook, Instagram, YouTube, LinkedIn, and whichever other related digital networks, in order to share information on such networks, this will enable both us and the social media networks of your choice, to identify you and associate the information that them or we, may have gathered about you. In any case, the information you share on such social media networks depends on the settings you establish on such networks in that regard, but in case you choose to share, such information will automatically be available to others, including friends and/or the general public. For more information on your information sharing preferences, please review the corresponding privacy policies of those social networks.

V. Non-personally Identifiable Information

Non-Personally Identifiable Information (hereinafter, “NPII”) refers to information that does not allow identifying a specific person, for example, statistical information and characteristics of our platform visitors and/or Users. It may enable identifying if a person fits into a specific group of people, but it is not unique and does not allow any person, in particular, to be described without other information. Below please find information on how we gather and use NPII on our website:

  1. Analytics Services:

    The platforms use analytics tools and services such as Google Analytics, Facebook Ads, Content Square, Criteo, among others, to monitor the use of the Platform, such as visitor frequency, what sections of the Platform they visit, and what related websites or platforms they may have visited prior to entering the Platform; and we use it to maintain and improve our site, products, and services.

  2. Cookies:

    Anonymous identifiers and other tracking technologies allow us to provide you with information that is customized for you. Please find our policy in that regard below.

  3. Log Files:

    We may (directly or through third parties) make use of log files, which includes internet protocol (IP) addresses, browser type, internet service provider (ISP), date/time stamp, referring/exit pages, pages visited, and whichever other related information that your browser may send to us. Such information may be used to analyze trends, administer our site, track users’ movement around our site, and gather information; and,

  4. Anonymous Information:

    Refers to information that does not identify an individual user, such as general aggregated or demographic information. Such information may be used or disclosed to third-party service providers, to improve our site and enhance your experience with our site, or to advertisers and partners.

VI. Cookie Policy

Cookies are small amounts of data that are stored on your browser, device, or the page you are viewing when you visit a website, and some are deleted once you close your browser or application, while others remain after you exit, so that you can be recognized when you return. Although they don’t contain information that personally identifies a user, the personal information stored about you by Bamba Group Corporation may be linked to the information stored in cookies. Our site uses and allows certain third parties to use cookies, for which we previously request your consent according to the terms hereunder. When entering the site, you agree to this policy and to the use of cookies.

The cookies we use on our platforms are divided into the following categories:

  1. Mandatory Cookies

    The ones that are required for operating our site, for example, those that allow you to log into secure areas;

  2. Functional Cookies

    Those that remember the choices from previous visits to our platform, such as language options, and allow us to personalize and assist you while browsing our website;

  3. Analytics

    These automatically collect information about your use of the site, in order to understand how many and in what manner users navigate and browse through our website, for purposes of analyzing their behavior, and following previous consent from such users; and,

  4. Marketing

    All other cookies that register your visit to our site, the pages and links you viewed previously and subsequently. They recognize you as a previous visitor and track your activity on our site and others you visit.

VII. Security

We use a variety of standardized security measures to ensure that your personal information is kept safe, including in the case of accidental loss and/or unauthorized access, use, alteration, and disclosure. The personal information you provide is stored on secure (password- and firewall-protected) servers. Likewise, we use encrypted technology to guarantee the safety of electronic financial transactions conducted through our platforms.

No data transmission made through the Internet can ever be 100% secure, so although we attempt to use the necessary measures to protect personal information, we cannot fully ensure that any information we provide or receive is secure. Therefore, if you have an account on our site, it is your responsibility to maintain the confidentiality of the password, and we will never ask for it, except at the moment in which you initially create the account.

1. Children

Please note that we have no interest in obtaining information from children under the age of 13, therefore we do not knowingly gather any personal information about them, but should you believe as a parent or guardian, that any child under the age of 13 has provided such information, please contact us at help@baboo.travel.

2. Modifications

The privacy policy hereunder may change from time to time, as a result of changes in technology and the industry. Should that be the case, we will post any changes made on the current page, and they will be effective immediately after having posted them. In order to determine when the privacy policy was last updated, check the date referred to in the “Last updated” section, and it is your responsibility to review it. By using our site after we have posted the referred changes, you implicitly agree and accept those changes, whether or not you have reviewed them.

3. Applicability

The policy hereunder applies solely to the information gathered by means of the Platform and/or Application, and not to information we may have obtained from other sources, such as through previous or ongoing employment or business relationship and/or information obtained by means of a telephone call and/or that was posted by you on any social media or business networking websites, such as Facebook, and/or Instagram, among others. The policy regarding the use of such information shall be governed in terms of their corresponding privacy policies.
